PN Bulk EA – Update 23

Members are advised that, following 2 days of intense bargaining on 11 and 12 July 2022, your
Negotiating Delegate Team have finally started to see significant movement from Pacific National
on one of your core claims, binding arbitration, as follows:

• Binding Arbitration – PN have now agreed in principle to include binding arbitration in
any final Agreement and moved towards a proposal put to them last week at our high-level
meeting at their North Sydney Office.

Discussions have continued on a process to facilitate a transition towards a mixed commodity
business model during the life of the Agreement, including a provision requiring a vote of affected
members in the first instance on any package that is negotiated.

Prior to finalising the above items, PN have agreed to release your negotiating delegates so they can hold membership meetings around the state. The purpose of member meetings is to brief, explain details and get feedback on the proposals for Binding Arbitration and the Transition process to Mixed Commodity/Facilitation of Change.

As a result of the above change in attitude from the Company, which has been achieved as a
direct result of ongoing protected industrial action, and to allow member meetings to occur, a
decision has been made by your Negotiating Team to suspend the following notified industrial
action:

• Once a shift, all members will stop their train for one hour at any load or unload point they
encounter during their shift. This may be before you load or unload the train (not during
loading). This will apply across both Coal and Bulk and will continue indefinitely.
• A ban on operating any bulk train over 40 wagons in length (all trains except coal trains).
• A ban on overtime.
• A ban on working on an RDO.
• A ban on the operation of distributive power coal trains.
• A ban on members not taking their meal break after 5 hours on duty.

The above action will be paused from 12 noon tomorrow 13th July 2022 until at least the next
bargaining meeting in 2 weeks’ time. This will allow member meetings to occur and facilitate
further intense bargaining.

Current actions relating to the placement of stickers on PN vehicles and assets, and the inclusion
of industrial campaign material in emails, will continue.

Should further progress not be made following the next round of negotiations protected industrial
action will be re-initiated.

A further Newsflash will be issued over the next few days outlining Depot meeting dates, times
and locations with all available members encouraged to attend.
