QUBE Federal Court matter & EA variation update

Members are advised of the following important developments regarding the ongoing legal proceedings and Enterprise Agreement variation.

Section 217 Variation – 2019 EA

Last week, the RTBU wrapped up the Section 217 variation of the 2019 Enterprise Agreement, and we await an outcome from the Fair Work Commission. This is a significant step forward in the proceedings. These proceedings only effect the 2019 EA, with the 2015 EA being illegible to be varied.

Federal Court – Timetable Confirmed

After numerous delays, timetable for the Federal Court matter has now been finalised. The case is listed to be heard in Melbourne in November/December 2026.

Critically, the Court has heard the RTBU’s concerns that this timetable must be upheld regardless of the status of the variation proceedings. Members should be aware of the following:

• If the variation of the 2019 EA continues to be delayed, the Federal Court will proceed to determine the claims under the 2015 EA only.
• The matter must proceed; this hearing date will not be lost.
