Aurizon NSW Coal update

Aug 24, 2023Aurizon Employer News

Return on availability dispute

Following our last newsflash on 18 August 2023, the Return on Availability Dispute was escalated to Aurizon’s General Manager of Operations. On 21 August 2023, Aurizon acknowledged and responded to our request to escalate the dispute to the GMO and as a result a further meeting has been arranged for 4th September 2023.

Even though Aurizon has committed to reviewing the extensive history of this dispute and to meet in accordance with the Dispute Resolution Procedure, they continue to maintain their disagreement with our views on their consultation proposals. As you may be aware Aurizon has also extended the consultation process despite our requests to cease this process.

On Monday 21 August 2023, Aurizon said they will not implement any changes regarding Return on Availability until the GM has considered the dispute. However, Aurizon appears intent to move forward with consultation and implementation. Today we have put Aurizon on notice about their continued disregard of the dispute resolution procedure.

Your Union is considering its options and may initiate proceedings with respect to the substantive dispute, and/or breaches of the Dispute Resolution Clause if Aurizon does not comply with the Agreement, and in particular observe the Status Quo.
