Clearance of Public Holidays with Rostered Annual Leave

Recently the Locomotive Division received reports of some members being denied the ability to clear accrued Public Holidays with their rostered annual leave; these reports led to the issuance of a Step 2 Dispute.

This dispute was resolved through Sydney Trains’ confirmation of Drivers’ entitlement to clear the accrued public holidays with rostered annual leave and rectification of the affected members issues in accordance with the following:

11.5.1 – Drivers Rostering and Working Arrangements Drivers have the option when rostered to work a holiday to receive payment for the holiday when it is worked or may nominate that it be accrued for clearance in conjunction with their annual leave. Drivers may accrue up to a maximum of eight (8) days and may be cleared or cashed out on application of the employee, subject to the election for payment or accrual. Crew who are rostered off duty on public holidays will automatically receive payment for the day.

The Locomotive Division wishes to commend members and delegates for protecting our entitlements and encourage all members to remain vigilant in ensuring Sydney Trains honour our hard-fought conditions of employment.

Any member who experiences difficulty clearing accrued public holidays with their rostered annual leave should contact their local delegate.
